The new UK Scale Up visa system aims to foster innovation by making it easier for ‘Scale Up’ businesses to attract “very highly skilled” and “academically elite” individuals to the UK. The individual must have a job offer from qualifying scale up businesses meeting all the criteria, similar to other sponsored routes. The Scale-up visa route is launched on 22 August 2022 and is intended to help UK Scale up businesses grow.

If you successfully obtain a UK Scale up Visa via the Unsponsored Application route, you will be granted entry clearance or permission to stay in the country for three years.
The Scale-up visa, like the Skilled Worker visa, will be part of the UK’s immigration points system. It is a settlement route, initially sponsored by an eligible Scale-up, eventually transitioning into an unsponsored route. Scale-up Workers may be eligible to apply for indefinite leave to remain in the UK after five years of continuous qualifying residence. Dependent partners and dependent children may apply to accompany or join a Scale-up Worker in the UK. Employers would need to show that they are a scale-up firm by demonstrating a growth rate of more than 20% in either annual average revenue or employment over a three-year period. They should have started with at least 10 employees during this period. Businesses that meet these requirements will be able to apply for the Scale-Up visa through a Fast-Track verification process, facilitating a faster and more simplified path to filling highly skilled UK jobs with the best international talent. If a candidate is already on leave to remain in another immigration category, their stay might be extended by switching to the Scale-up route unless they have or were previously granted, permission as a Visitor, Short-term student, Parent of a Child Student, Seasonal Worker, Domestic Worker in a Private Household, or outside the Immigration Rules.

You can extend your visa as many times as you like by 3 years, as long as you still meet the eligibility requirements.After 5 years, you may be able to apply to settle permanently in the UK.
You will be able to switch employers while on a scale-up visa, however, while renewal you will need to qualify for a relevant visa type. For instance, if you change employers and the new employer is not a scale-up company you will require another type of UK visa, such as a skilled worker visa. Scale-up Workers will be able to switch to different sponsored roles in the first six months, and after at least six months in sponsored work, Scale-up Workers can undertake any work (including self-employment and voluntary work) except for work as a professional sportsperson or coach.
Refusal of this application carries a right of administrative review due to case working errors. The applicant may also pursue the Judicial Review option if they wish to challenge the decision.
Unlike the Skilled Worker category and the Senior or Specialist Worker route under the Global Business Mobility category, there is no Immigration Skills Charge for a Scale-up visa sponsorship.
