The new UK Scale Up visa system aims to foster innovation by making it easier for ‘Scale Up’ businesses to attract “very highly skilled” and “academically elite” individuals to the UK. The individual must have a job offer from qualifying scale up businesses meeting all the criteria, similar to other sponsored routes.  The Scale-up visa route is launched on 22 August 2022 and is intended to help UK Scale up businesses grow.  

Requirement for a Scale up Visa Sponsored Application

The key requirement to be eligible to apply for a scale-up visa route is as follows:

  • Be 18 or over, and must have a valid Certificate of Sponsorship (CoS) from a UK Sponsor
  • The job should be genuine, at a suitable skill level, and listed on the eligible occupation list
  • Be competent in the English language to at least CEFR Level B1 (equivalent to IELTS 4.0)
  • The salary must be equivalent to or exceed £34,600 per year or the going rate for the job, whichever is the highest
  • Have sufficient funds of £1,270 or more for at least 28 consecutive days in your bank account before you apply

A successful candidate will be granted entry clearance or permission to remain in the country for two years, after that they can extend their stay for additional three years.

Requirement for a UK Scale up Visa Unsponsored Application

The key requirement to be eligible to apply for a scale-up visa route is as follows:

  • Be 18 or over, have previously been granted permission as a Scale-up Worker
  • The monthly PAYE earnings in the UK should be equivalent to at least £33,000 per year during at least 50% of your most recent grant of permission as a Scale-up Worker
  • If already been in the UK for more than 1 year, there is no need to show any funds
  • Be competent in the English language to at least CEFR Level B1 (equivalent to IELTS 4.0)

If you successfully obtain a UK Scale up Visa via the Unsponsored Application route, you will be granted entry clearance or permission to stay in the country for three years.

The Scale-up visa, like the Skilled Worker visa, will be part of the UK’s immigration points system. It is a settlement route, initially sponsored by an eligible Scale-up, eventually transitioning into an unsponsored route. Scale-up Workers may be eligible to apply for indefinite leave to remain in the UK after five years of continuous qualifying residence. Dependent partners and dependent children may apply to accompany or join a Scale-up Worker in the UK. Employers would need to show that they are a scale-up firm by demonstrating a growth rate of more than 20% in either annual average revenue or employment over a three-year period. They should have started with at least 10 employees during this period. Businesses that meet these requirements will be able to apply for the Scale-Up visa through a Fast-Track verification process, facilitating a faster and more simplified path to filling highly skilled UK jobs with the best international talent. If a candidate is already on leave to remain in another immigration category, their stay might be extended by switching to the Scale-up route unless they have or were previously granted, permission as a Visitor, Short-term student, Parent of a Child Student, Seasonal Worker, Domestic Worker in a Private Household, or outside the Immigration Rules.
